ACCEPTANCE OF TERMS
By accessing our website at go.influencemagnet.com or using our marketing services you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms please do not use our services.
DESCRIPTION OF SERVICES
Influence Magnet provides done-for-you digital marketing services exclusively for home service businesses starting with HVAC companies. Our services include Google Business Profile optimization, AI phone answering setup and management, missed call text-back automation, review automation, reactivation campaigns, pipeline and CRM management, and 15-day performance reporting.
SERVICE GUARANTEE
We guarantee 50 verified inbound calls within 6 months of service commencement. A verified inbound call is defined as a phone call received by the client's business through our system that lasts longer than 30 seconds. If we fail to deliver 50 verified inbound calls within 6 months we will continue providing services at no charge until the guarantee is met. The client must remain subscribed for the full 6 months to qualify for the guarantee.
PAYMENT TERMS
Monthly retainer: $1,500 per month
Payment is due on the same date each month
First payment is due upon signing the client service agreement
Payments are non-refundable after 7 days of service commencement
Late payments may result in service suspension
MINIMUM COMMITMENT
Services require a minimum commitment of 2 months to allow sufficient time to build, launch, and generate results. After the initial 2 months the service becomes month-to-month with 30 days written notice required for cancellation.
CLIENT RESPONSIBILITIES
To receive our services clients must:
Provide accurate and complete business information through our onboarding form
Provide access to Google Business Profile, website, and other necessary platforms
Provide an existing customer list for reactivation campaigns where applicable
Respond to our communications within 48 hours
Ensure their business phone number is properly configured
Maintain payment obligations throughout the service period
INTELLECTUAL PROPERTY
All marketing systems, workflows, automations, templates, and strategies created by Influence Magnet remain the intellectual property of Influence Magnet. Clients receive a license to use these systems during the service period. Upon termination of services client access to our proprietary systems will be removed.
CONFIDENTIALITY
Both parties agree to keep confidential all proprietary information shared during the service relationship. Influence Magnet will not share client business data, customer lists, or business information with any third party except as necessary to deliver our services.
LIMITATION OF LIABILITY
Influence Magnet's liability to any client shall not exceed the total amount paid by that client in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages including loss of revenue or business opportunities. We are not responsible for results that depend on factors outside our control including how clients handle inbound leads, close rates, or pricing decisions.
TERMINATION
Either party may terminate services with 30 days written notice after the minimum 2 month commitment.
We reserve the right to terminate services immediately if:
Payment obligations are not met after 14 days
Client violates these terms and conditions
Client engages in illegal or unethical business practices
Upon termination all outstanding payments become immediately due.
DISCLAIMER OF WARRANTIES
Our services are provided on an as is basis. While we guarantee 50 inbound calls we cannot guarantee specific revenue outcomes as these depend on factors outside our control including how clients handle and convert leads.
GOVERNING LAW
These Terms and Conditions are governed by the laws of British Columbia, Canada. Any disputes shall be resolved in the courts of British Columbia.
CHANGES TO TERMS
We reserve the right to modify these Terms and Conditions at any time. We will provide 30 days notice of material changes. Continued use of our services after changes constitutes acceptance.
